By engaging Emba Studio for photography services, using this website, or proceeding with a booking, you agree to the following Terms & Conditions.
1. BOOKINGS & PAYMENTS
A booking is confirmed once the required deposit invoice has been paid. A non-refundable 50% deposit is required to secure all shoot dates unless otherwise agreed in writing. The remaining balance must be paid prior to final image delivery.
Emba Studio reserves the right to withhold final imagery until full payment has been received. All pricing is listed in AUD unless otherwise stated.
2. CANCELLATIONS & RESCHEDULING
Deposits are non-refundable. Rescheduling requests are subject to availability. Emba Studio reserves the right to reschedule shoots where weather conditions, lighting conditions or unforeseen circumstances may negatively impact image quality or safety. In the event of client cancellation within 7 days of the scheduled shoot date, Emba Studio reserves the right to retain the full deposit.
3. CLIENT RESPONSIBILITIES
Clients are responsible for ensuring:
the property is clean and shoot-ready prior to arrival;
all styling is completed before the scheduled shoot time;
access to the property is arranged;
all necessary permissions for photography have been obtained.
Any delays caused by site unpreparedness may reduce available shoot time or incur additional fees.
4. CREATIVE DIRECTION
Emba Studio maintains full creative discretion throughout the shoot and editing process. While collaborative input, references and briefs are welcomed, final decisions regarding composition, editing style, image selection and artistic direction remain at the discretion of Emba Studio. By booking Emba Studio, the client acknowledges familiarity with the existing portfolio and editing style.
5. IMAGE DELIVERY & TURNAROUND
Proof galleries and final delivery timelines are estimates only and may vary depending on project scope and workload. Final edited images will be delivered digitally via an online gallery or cloud-based transfer platform. Clients are responsible for downloading and backing up all delivered files upon receipt.
6. COPYRIGHT & IMAGE USAGE
All images captured by Emba Studio remain the intellectual property and copyright of Emba Studio. Clients are granted a non-exclusive licence to use delivered imagery for agreed business, marketing and promotional purposes only.
Images may not be:
resold;
heavily altered;
submitted into competitions;
supplied to third parties outside the agreed scope;
without written consent from Emba Studio.
Commercial licensing beyond agreed usage may incur additional fees.
7. PORTFOLIO & MARKETING USE
Unless otherwise agreed in writing prior to the shoot, Emba Studio reserves the right to use imagery for:
portfolio purposes;
website content;
social media;
marketing;
publications;
promotional material.
Clients requesting confidentiality or delayed publication must communicate this prior to the shoot date.
8. LIMITATION OF LIABILITY
Emba Studio takes all reasonable care in providing photography services and safeguarding captured files. However, Emba Studio shall not be held liable for:
unforeseen equipment failure;
file corruption;
weather conditions;
acts of nature;
illness;
accidents;
delays caused by third parties;
circumstances beyond reasonable control.
Liability is limited to the amount paid by the client for the affected services.
9. WEBSITE CONTENT
All content displayed on this website, including imagery, branding, logos, copy and design elements, remains the property of Emba Studio and may not be copied, reproduced or distributed without written permission.
10. CHANGES TO TERMS
Emba Studio reserves the right to update or modify these Terms & Conditions at any time without prior notice.
